The reconstruction of insolvency law as reflexive debt deliberation relays on three theoretical models: a transformative understanding of law (‘transformative law’) as legal constitutionalism, a ‘discoursive normative grammar’ (DNG) framework of social deliberation, and the system ordering idea of ‘reflexive sustainabilities’ and. The project elaborates and validates these models as general methodologies as well as analytical frameworks of the reflexive debt idea.
