Consumer Insolvency Regimes
In the field of consumer insolvency, the comparative analysis mainly focuses on debt discharge. Our primary interest is to compare the normative background of provisions that determine the time frame, e.g., the duration of a discharge procedure and blocking periods as well as financial and behavioral prerequisites of discharge procedures such as financial education, or restrictions in the debtor’s private or professional life. These factors illustrate how individual responsibilities or structural aspects of insolvency shape the consumer debt regulation in various ways.
